Prop 8 trial
Jan. 25th, 2010 | 06:45 pm
OK - I think P8 should be overturned but the arguments I keep hearing are completely irrational arguments. Two complaints I have heard:
1) The Yes on 8 campaign used exaggerated arguments and fear...
Um so what? On every issue BOTH sides appeal to fear and exaggerate the negatives. That's hardly unconstitutional... Otherwise we could overturn every law ever passed on that criteria.
2) Some guy's parents tried to turn him straight by sending him to a religious camp when he was a kid...
WTF? What does that have to do with marriage and equal contractual rights? He wasn't even at legal marrying age.
Arguments like this just make the Yes on 8 argument appear to be ridiculous.
The bottom line is that the US Constitution (and I assume the CA constitution) guarantee equal opportunity. People are being denied an equal opportunity (cost and difficulty) to enter into a civil union based on their sexual orientation.
The only thing the court has to determine is if any two or more persons may enter into a civil union for small fee (about$35) and a single signature. AND whether or not sexual orientation is a determining factor for entering into a civil union. ...Government needs to stop referring to this as "marriage" because gays can get married in spirit already. They just don't get the same economic and contractual benefits.
Will this ruling apply to people who are bi-sexual?
